Welcome to OPD.Care. These Terms of Service ("Terms") govern your access to and use of OPD.Care's platform, mobile applications, and related services. By using OPD.Care, you agree to be bound by these Terms.
1. Parties to the Agreement
These Terms form a legally binding agreement between you (User: Doctor, Clinic, Hospital, Patient) and Devloops Technologies Pvt Ltd, the operator of OPD.Care.
2. Eligibility
You must be at least 18 years old or under the supervision of a parent/legal guardian. Organizations must authorize usage on their behalf.
3. Services Provided
OPD.Care offers:
- Appointment scheduling
- Electronic Medical Records (EMR)
- SMS/email reminders
- Billing and prescriptions
- Health analytics and dashboards
We reserve the right to modify or discontinue any service at our discretion.
4. User Obligations
By using OPD.Care, you agree to:
- Provide accurate and truthful information
- Keep your login credentials confidential
- Use the services only for legal healthcare purposes
- Maintain patient confidentiality
- Comply with applicable medical ethics and laws (e.g. NMC)
5. Patient Data & Privacy
Your data is handled in accordance with:
- OPD.Care Privacy Policy
- DPDP Act, 2023
- SPDI Rules under the IT Act
- IMA guidelines
You may access, update, or request deletion of your data at any time, subject to legal exceptions.
6. Data Security
We follow ISO/IEC 27001 standards:
- AES-256 encryption for data at rest
- HTTPS/TLS for secure data transmission
- Role-Based Access Control (RBAC)
- OTP/MFA login
- Regular vulnerability scans and audits
You are responsible for maintaining the confidentiality of your credentials.
7. Subscriptions & Fees
Some services are subscription-based. By subscribing, you agree to:
- Pay all applicable fees as per your plan
- Receive digital invoices
- Follow our refund/cancellation policy
- Accept that non-payment may lead to service suspension
8. Acceptable Use Policy
You agree NOT to:
- Misrepresent yourself or impersonate a healthcare provider
- Post false medical data
- Harass or abuse other users
- Violate privacy or intellectual property rights
We reserve the right to suspend or terminate your account for violations.
9. Third-Party Services
We integrate with services like labs, payment processors, and SMS gateways. Their respective terms also apply. We are not responsible for their failures or misuse.
10. Intellectual Property
All content, software, and branding on OPD.Care are the property of Devloops Technologies Pvt Ltd. You may not:
- Copy, reverse engineer, or resell any part of the service
- Use our trademarks without permission
11. Limitation of Liability
We are not liable for:
- Any medical errors or malpractice by providers
- Unauthorized access due to user negligence
- Force majeure events
Total liability is limited to the amount you paid in the last 6 months.
12. Termination
We may suspend or terminate your account:
- For violating these Terms
- Due to legal/regulatory requirements
- Upon request from you
You may request deletion of your data at any time.
13. Indemnification
You agree to indemnify OPD.Care from any legal claims or damages arising from your use of the platform or violation of these Terms.
14. Dispute Resolution
Disputes will be resolved through mediation first. If unresolved, they shall be subject to the courts of Vadodara, Gujarat under Indian law.
15. Modifications
We may update these Terms. Updated versions will be posted online. Continued use implies your agreement to the updated Terms.
